Welcome to the terms and conditions ("Terms") for The Wild Geese Irish Heritage Partnership (“Heritage Partnership”). These Terms are between you and GAR Media LLC (“GAR” or "Us") and govern our respective rights and obligations. The Terms, together with applicable terms and conditions related to any promotional offers provided to you for use with the Heritage Partnership, constitute the entire agreement between you and GAR related to the Heritage Partnership. Please note that your use of The Wild Geese website and Heritage Partnership are also governed by our Conditions of Use and Privacy Notice, as well as all other applicable terms, conditions, limitations, and requirements on The Wild Geese website, all of which (as changed over time) are incorporated into these Terms. If you sign up for a Heritage Partnership, you accept these terms, conditions, limitations and requirements. Please read these Terms carefully.

Some Limitations
We reserve the right to accept or refuse participation in the Heritage Partnership at our discretion.

You may not transfer or assign your Heritage Partnership membership or other benefits to any other person or entity.

From time to time, GAR may choose in its sole discretion to add or remove Heritage Partnership benefits from paid or free promotional programs. By agreeing to these Terms you acknowledge that GAR may change such benefits without notice.

Fees and Renewal
The various options for membership in the Heritage Partnership, including fees, are available upon request. Membership fees are non-refundable except as expressly set forth in these Terms. Taxes may apply on your Heritage Partnership fee, and you agree that you will be solely liable for such taxes.

Heritage Partnerships can be paid for via checks, credit cards or PayPal.

If all credit cards we have on file for you are declined for payment of your membership fee, you have 30 days to provide us a new credit card or your membership will be canceled. If you provide us with a new card and are successfully charged within 30 days, your new membership period will be based on the original renewal date and not the date of the successful charge.

UNLESS YOU NOTIFY US BEFORE A CHARGE THAT YOU WANT TO CANCEL OR DO NOT WANT TO AUTO RENEW, YOU UNDERSTAND THAT YOUR PARTICIPATION IN THE HERITAGE PARTNERSHIP WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE AND ANY TAXES, USING ANY CREDIT CARD WE HAVE ON RECORD FOR YOU.

Payments
We'll bill your credit card the fee stated at the time of purchase plus any applicable tax. As soon as you've successfully completed our sign-up process and your payment is confirmed, your membership will begin.

Renewal
The respective membership prices are valid for a full 3-, 6- or 12-month period, depending on which membership option you select. After the respective membership period ends, we'll renew your contract automatically for the same term unless you cancel. Membership prices are subject to change, but we will always notify you of your renewal date and any price increases beforehand.

Cancellation
We'd hate to lose your support, but if you cancel within the first 30 days we will refund you 60% of the contracted fee. If you ever need to cancel, just contact our team at partnerships@TheWildGeese.com. After 30 days, membership fees are non-refundable unless required by law.

Promotional Trial Memberships
We sometimes offer certain customers various trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the promotional offers. Trial members may at any time choose not to continue to paid membership at the end of the trial period by notifying GAR via partnerships@TheWildGeese.com or by phone, Skype or regular mail.

Agreement Changes
We may at our discretion change these Terms, TheWildGeese.com’s Conditions of Use and Privacy Notice, or any aspect of the Heritage Partnership, without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED PARTICIPATION AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

Termination by Us
We may terminate your participation in the Heritage Partnership at our discretion without notice. If we do so, we will give you a prorated refund based on the number of full months remaining in your membership. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms, TheWildGeese.com’s Conditions of Use, any other agreement or terms set forth by GAR, or any applicable law, involves fraud or misuse of the Heritage Partnership membership, or is harmful to our interests or those of another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.

Governing Law
This Agreement and GAR’s provision of services hereunder shall be governed by the laws of the State of New York without regard to its – or any other jurisdiction’s – conflicts of laws rules.

Limitation of Liability

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN TheWildGeese.com’s CONDITIONS OF USE, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, MEMBERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO MEMBERSHIP. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST MEMBERSHIP FEE YOU PAID. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR MEMBERSHIP. CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
